Xelnovia PBX services may only be used for lawful, authorized, and legitimate business communication purposes in compliance with applicable telecommunications, privacy, consumer protection, and messaging regulations.
Users are responsible for ensuring their communications practices comply with:
- Applicable telecom laws and regulations
- A2P 10DLC messaging requirements
- Carrier policies and industry standards
- Consent and opt-in obligations
- Anti-spam and consumer protection laws
2. Prohibited Activities
The following activities are strictly prohibited:
- Fraudulent calling or deceptive communications
- Caller ID spoofing or impersonation
- Spam, phishing, or unauthorized bulk messaging
- Transmission of malware or malicious traffic
- Harassment, threats, abuse, or unlawful communications
- Robocalling or auto-dialing in violation of applicable laws
- SMS traffic without proper user consent
- Snowshoe messaging or message evasion tactics
- Traffic pumping, artificial inflation, or revenue abuse schemes
- Attempts to bypass carrier restrictions or compliance systems
3. Messaging and SMS Compliance
Customers using SMS or MMS services must obtain proper consent from recipients before sending communications.
Customers are solely responsible for maintaining proof of consent, opt-in records, and communication authorization where required.
All SMS campaigns and messaging activity must comply with carrier rules, A2P 10DLC standards, TCPA requirements, and applicable anti-spam regulations.
Recipients must be provided with clear opt-out instructions. Users must immediately honor opt-out requests, including messages containing STOP, UNSUBSCRIBE, CANCEL, or similar requests.
4. Security and Credential Responsibility
Customers are responsible for protecting account credentials, endpoint devices, SIP authentication details, and administrator access.
Users must implement reasonable safeguards to prevent unauthorized access, toll fraud, account abuse, or security compromise.
Failure to maintain adequate security controls may result in suspension or restriction of services where necessary to protect infrastructure integrity.
5. High-Risk and Illegal Traffic
The following traffic categories are strictly prohibited on the Xelnovia PBX platform:
- Scam operations or fraudulent call centers
- Illegal robocalling campaigns
- Phishing or social engineering operations
- Unlawful debt collection activity
- Traffic intended to evade law enforcement or carriers
- Unauthorized international traffic routing
- SIM farms or traffic manipulation systems
- Illegal gambling, fraud, or deceptive marketing operations
6. Network Integrity and Platform Protection
Users may not interfere with, disrupt, damage, overload, or compromise the stability, integrity, or security of Xelnovia PBX systems or networks.
Prohibited technical activities include:
- Denial-of-service attacks or abusive traffic flooding
- Unauthorized penetration testing or scanning
- Exploitation of software vulnerabilities
- Distribution of malware or malicious code
- Attempts to bypass authentication or access controls
7. Monitoring and Investigation
Xelnovia PBX reserves the right to investigate activity that may threaten:
- Platform stability or infrastructure security
- Carrier compliance requirements
- Customer safety or service reliability
- Legal or regulatory obligations
Investigations may include traffic analysis, abuse monitoring, account review, carrier complaint handling, and cooperation with lawful requests from authorities.
8. Enforcement Actions
Violations of this Acceptable Use Policy may result in:
- Warnings or compliance notices
- Traffic filtering or route restrictions
- SMS capability suspension
- Temporary or permanent account suspension
- Immediate service termination
- Referral to carriers or legal authorities where appropriate
Enforcement actions may occur without prior notice where immediate action is necessary to protect systems, carriers, customers, or legal compliance obligations.
